Cases of violence against children are increasingly rampant in Bali. Children must receive legal protection as stipulated in the International Convention on the Rights of the Child. For this reason, we, the LBH Pemuda Sejati (LBH PS) team in Bali have provided a lot of legal protection for children and women as victims of crime by providing legal assistance both in the Police, Attorney General’s Office and up to the Court. As we know that Indonesia has made Law Number 23 of 2002 concerning Child Protection which has the following principles:
- the best interests of the child;
- the right to life, survival and development; and
- respect for children’s opinions.
In article 80 paragraph 1 of the Child Protection Law stipulates strict sanctions against “Anyone who commits cruelty, violence or threats of violence, or abuse against a child, shall be sentenced to imprisonment of 3 (three) years 6 (six) months and / or a maximum fine of Rp. 72,000,000.00 (seventy two million rupiah) ”.
Fornication and rape of children are also strictly regulated in Article 81 paragraph 1 of the Child Protection Law which reads “Any person who deliberately commits violence or threatens violence to force a child to have intercourse with him or another person, shall be punished with imprisonment of a maximum of 15 ( fifteen) years and a minimum of 3 (three) years and a maximum fine of Rp. 300,000,000.00 (three hundred million rupiah) and at least Rp. 60,000,000.00 (sixty million rupiah) ”
Our experience from the LBH Pemuda Sejati (LBH PS) team in assisting child victims of crime is that there is poor information from the family and there are indications that the family is covering up cases that have befallen their children. We, the LBH Pemuda Sejati (LBH PS) team provide legal assistance to children and women who are victims of crime, by previously approaching the victims and their families.
Cases of child abuse and rape and sexual abuse of girls are very common in Bali. Both the perpetrators are adults and still in the age category of children, where the majority of children are victims of crimes of rape / sexual immorality (sexual offenses) which are mostly committed by the closest people of the child, namely family, neighbors, friends on social media. Not infrequently the incident results in pregnancy, of course this will damage the child’s future and will affect the child psychologically when the child of the victim of the crime gives birth to the child of the crime of the perpetrator.
According to our experience, the LBH Pemuda Sejati (LBH PS) team, the causes of the rampant cases of violence against children and women in Bali are the lack of communication between the victims and their families, the lack of care and attention from their immediate family, friends and the ignorance of the surrounding community, apart from being caused by poverty, the influence of lifestyle. Free sex, advances in the internet and social media that lead to negative things such as free sex, abortion, narcotics, and other child delinquency.
In Bali there is also rampant trafficking of children and women to become commercial sex workers (CSWs), where children are served as waiters for cafes, spas and nightclubs, with the job of accompanying café visitors to drink alcohol and often being asked to accompany café visitors to have free sex. . Physical violence against children also occurs there, although sometimes they give compensation money so that this case is not exposed, we, the team of LBH Pemuda Sejati (LBH PS) are always tracking if there is an indication like that.
